1. Agreement to Terms

By accessing or using the Kearney's Gardens website at kearneysgardens.ie ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Website.

2. Service Description

Kearney's Gardens is a flower shop and garden centre offering fresh bouquets, floral arrangements, planters, gifts, and workshops. Through this Website you may browse our products, reserve orders for in-store collection, book workshops, and contact us with enquiries. All orders are reserved online and paid for at the shop on collection.

3. Intellectual Property

All content on this Website — including text, images, logos, product photographs, designs, and code — is the property of Kearney's Gardens or its licensors and is protected by Irish and international copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.

4. User Responsibilities

When using this Website, you agree to:

  • Provide accurate and truthful information when placing orders or contacting us.
  • Use the Website only for lawful purposes and in a manner that does not infringe the rights of others.
  • Not attempt to gain unauthorised access to any part of the Website or its systems.

5. Orders and Pricing

All prices are displayed in Euros (€) and include VAT where applicable. We reserve the right to change prices at any time without prior notice, though orders already confirmed will be honoured at the price shown at the time of purchase.

We reserve the right to refuse or cancel any order at our discretion, for example due to stock availability. As payment is taken at the shop on collection, no refunds apply to cancelled reservations. If you do not collect your order within seven (7) days of the requested pickup date and have not contacted us, we reserve the right to release the items.

6. Limitation of Liability

To the fullest extent permitted by Irish law, Kearney's Gardens shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website or our services.

We make every effort to display accurate product images and descriptions, but due to the natural variation in flowers and plants, the actual arrangement you collect may vary slightly from those shown on the Website. This does not constitute a defect.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

7. Governing Law

These Terms shall be governed by and construed in accordance with the Laws of Ireland. Any disputes arising from or related to these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you have a dispute or complaint, we encourage you to contact us first at hello@kearneysgardens.ie so we can try to resolve it informally. The European Commission also provides an Online Dispute Resolution platform.
